By creating an account or using The Afterlife, you confirm that you are at least 18 years of age and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

We reserve the right to modify these Terms at any time. We will notify you of any material changes via email or through the Service. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

The Afterlife is a digital legacy platform that allows users to:

• Create secure digital vaults to store important information, documents, and media
• Designate recipients who will receive access to vault contents upon verified passing
• Configure a "Heartbeat Protocol" for periodic check-ins to verify continued well-being
• Optionally require death certificate verification before vault release
• Manage digital legacy planning in a secure, encrypted environment

The Service is provided "as is" and we continuously work to improve and expand its features.

Account Creation: You must provide accurate, complete, and current information when creating your account. You are responsible for maintaining the confidentiality of your account credentials.

Account Security: You are responsible for all activities that occur under your account. Notify us immediately of any unauthorized access or security breach at info@theafterlife.co.za.

Heartbeat Protocol: If you enable the Heartbeat Protocol, you agree to respond to periodic check-in notifications. Failure to respond after the configured grace period may trigger the vault release process to your designated recipients.

You agree not to use the Service to:

• Store, share, or distribute illegal content or materials
• Violate any applicable laws, regulations, or third-party rights
• Upload malware, viruses, or other harmful code
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or its infrastructure
• Use the Service for money laundering, fraud, or other criminal activities
• Impersonate any person or entity
• Collect or harvest user data without authorization

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

Free Tier: We offer a free tier with limited features. Free accounts may have restrictions on storage, number of vaults, and recipients.

Paid Plans: Premium features are available through paid subscription plans. Subscription fees are billed in advance on a monthly or annual basis, depending on your chosen plan.

Payment Processing: All payments are processed securely through our third-party payment providers. We do not store your full payment card details.

Refunds: Subscription fees are generally non-refundable. However, we may provide refunds at our discretion in exceptional circumstances. Contact support for refund requests.

By You: You may terminate your account at any time through your account settings or by contacting support. Upon termination, your data will be deleted according to our data retention policy.

By Us: We may suspend or terminate your access to the Service if you violate these Terms, engage in fraudulent activity, or for any other reason at our sole discretion with reasonable notice where possible.

Effect of Termination: Upon termination, your right to use the Service ceases immediately. We may retain certain information as required by law or for legitimate business purposes.

Service Availability: We strive for high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance or updates that temporarily affect availability.

No Warranty: THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROYAL FAMIGLIA (PTY) LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

Death Verification: While we take reasonable steps to verify death claims before releasing vaults, we cannot guarantee absolute accuracy. Users and recipients acknowledge and accept this limitation.

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of South Africa.
